Terms and Conditions

1. Introduction

These Terms & Conditions of Use (“Terms”) apply to your access to and use of the website, mobile application, online booking services, guest-service platforms, hotel digital services and other online or offline services made available by Atrium Hotels & Resorts.

By accessing, browsing, using, transmitting, caching, storing information on, making a booking through, or otherwise using the website, mobile application or related services, you agree to comply with these Terms.

If you do not agree with these Terms, you should not use the website, mobile application or related services.

2. Who we are

For the purposes of these Terms, references to “Atrium Hotels & Resorts”, “we”, “us” or “our” mean, as applicable depending on the hotel, service, booking or interaction concerned, one or both of the following legal entities:

 

1. XENODOCHIAKES TOURISTIKES EPICHIRISIS S.A. “PRESIDENTIAL”, Ixia Beach, 85133 Rhodes, Greece, owner of Atrium Platinum; and

2. XENODOCHIAKES TOURISTIKES EPICHIRISIS NOTIOANATOLIKIS RODOU S.A. “ATRIUM PALACE”, Kalathos, 85102 Rhodes, Greece, owner of Atrium Palace and Atrium Prestige.

 

The hotels operate under the brand name Atrium Hotels & Resorts. Unless the context requires otherwise, references to Atrium Hotels & Resorts are intended to apply to all hotels, services and facilities operating under that brand, including Atrium Platinum, Atrium Palace and Atrium Prestige.

4. Use of the website and services

Our website is made available free of charge.

You may use the website, mobile application and related services only for lawful purposes and in accordance with these Terms.

The services are available only to individuals who can form legally binding contracts under applicable law. By using the website, mobile application or booking services, you represent that you are of sufficient legal age and legal capacity to use the services and to create binding legal obligations for any liability you may incur.

You also confirm that you are legally authorized to make travel reservations, purchases or service requests for yourself or for any other person on whose behalf you act.

You may use the website, mobile application and services only to make legitimate reservations, purchases or service requests. You must not use them to make speculative, false, fraudulent, abusive or resale-related reservations or requests.

Commercial use of the website, mobile application or services is prohibited unless Atrium Hotels & Resorts has given prior written consent.

5. Accuracy of information provided by you

All information you provide in connection with your use of the website, mobile application, booking services, hotel services or guest services must be true, accurate, current and complete.

We may rely on the information you provide. You are responsible for any errors, omissions, inaccuracies or consequences resulting from information submitted by you or on your behalf.

6. Availability of the website and services

We do not guarantee that the website, mobile application or any content, function or service will always be available, uninterrupted, secure or error-free.

Access is permitted on a temporary basis. We may suspend, withdraw, discontinue, restrict or change all or any part of the website, mobile application or related services without notice.

We shall not be liable if the website, mobile application or any related service is unavailable at any time or for any period, except where liability cannot be excluded under applicable law.

You are responsible for making all arrangements necessary to access the website, mobile application and services. You are also responsible for ensuring that any person who accesses them through your device, account or internet connection is aware of and complies with these Terms.

7. Prohibited use

You agree not to:

  • use the website, mobile application or services in breach of any domestic, European or international law;
  • use them in any fraudulent, abusive, harmful, unlawful or misleading manner;
  • make speculative, false, fraudulent or resale-related reservations;
  • transmit defamatory, libellous, obscene, offensive, threatening or unlawful material;
  • infringe the rights of any third party;
  • send spam, chain letters, junk mail, bulk communications or unauthorized solicitations;
  • interfere or attempt to interfere with the proper operation of the website, mobile application or services;
  • attempt to gain unauthorized access to systems, data, accounts or networks;
  • introduce viruses, malware or harmful code;
  • use automated tools, scraping, bots or similar technologies without our prior written consent.

We may cancel, modify, suspend or refuse any transaction, booking, request or access where we reasonably believe that fraudulent, abusive, inappropriate or unlawful activity has occurred, or where a transaction appears to contain or result from an error or mistake.

8. Data protection

Atrium Hotels & Resorts respects your privacy. Information about how we collect, use, store and share personal data is set out in our Privacy Policy / Privacy Notice and Cookie Policy.

Our Privacy Policy / Privacy Notice applies to the website, mobile application, online booking services, guest registration forms, hotel stay, guest services, guest satisfaction surveys, concierge requests, room-service orders, restaurant reservations, third-party service requests and other interactions with us.

By using our website, mobile application or guest services, you acknowledge that your personal data may be processed in accordance with our Privacy Policy / Privacy Notice and Cookie Policy. This does not mean that all processing is based on consent; where consent is required, it will be requested separately.

9. Intellectual property rights

The website, mobile application and all content, materials, designs, text, images, photographs, videos, logos, icons, graphics, trade names, trademarks, service marks, software, interfaces, databases, layout, look and feel, and other intellectual-property rights displayed or made available through them are owned by or licensed to Atrium Hotels & Resorts or its licensors.

No license, title or right in any such intellectual property is granted to you except as expressly stated in these Terms.

You may download, display and print one copy of materials from the website for your personal, non-commercial use only, provided that you retain all copyright, trademark and proprietary notices.

You must not reproduce, distribute, modify, upload, post, transmit, republish, sell, exploit, frame, mirror, scrape or use any content from the website or mobile application for commercial purposes without prior written consent from Atrium Hotels & Resorts.

10. Trademarks

The trademarks, logos, service marks, trade names and trade dress displayed on the website, mobile application or hotel materials are owned by or licensed to Atrium Hotels & Resorts or other relevant rights holders.

Nothing in these Terms grants any right or license to use any trademark, logo, service mark, trade name or trade dress without the prior written permission of Atrium Hotels & Resorts or the relevant rights holder.

Unauthorized use is prohibited.

11. Reservation policy

11.1 Pre-booking services

Online pre-booking services are provided for information purposes and allow users to check room availability, prices, packages or other information relating to Atrium Hotels & Resorts.

Pre-booking information does not constitute a confirmed booking unless and until the booking is completed and confirmed in accordance with the applicable booking conditions.

 

11.2 Online booking services

Our online booking services may be powered by third-party booking engine providers, including WebHotelier Technologies Limited, Mnasiadou Street number 9, Dimokritos Building, Office 16, 1065 Nicosia, Cyprus, or other providers used from time to time.

The purpose of the online booking services is to allow users to reserve accommodation or related services at Atrium Hotels & Resorts.

Use of the online booking services implies acceptance of these Terms and the applicable booking conditions, including the rate-specific payment, deposit, cancellation and no-show terms shown during the booking process.

 

11.3 Prices and taxes

Prices displayed on the website or booking engine may vary depending on dates, hotel, room type, number of guests, package, board basis, availability, taxes, charges and booking conditions.

Meals, services, VAT, government-imposed charges, municipal charges, accommodation taxes, climate resilience fees or similar charges are included only where expressly stated.

Any applicable government-imposed accommodation tax, climate resilience fee, municipal tax or similar charge shall be paid by the guest in accordance with applicable Greek law, unless expressly stated otherwise during the booking process.

The hotel reserves the right to apply any new or amended taxes, duties, fees or charges in accordance with applicable law.

 

11.4 Payment, deposit and guarantee

At the time of booking or check-in, we may request credit-card or debit-card details and you authorize the use of that card for any sums that become due to us in connection with your booking, stay or services.

Depending on the rate and booking conditions selected, your card may be charged for the full amount or part of the total amount at the time of booking. Any remaining amount may be due upon check-in, arrival, during your stay or upon check-out, as specified in the applicable booking conditions.

We may require full or partial payment in advance for certain rates, packages, services or booking types.

No booking shall be treated as confirmed until the required details, payment, deposit, guarantee or authorization have been provided and the booking has been confirmed.

If your card is declined, payment authorization is not completed or required payment is not received, your booking may be treated as unconfirmed, placed on hold or cancelled in accordance with the applicable booking conditions.

The credit or debit card used at the time of booking may need to be presented upon check-in, and the cardholder may be required to sign the relevant payment slip or authorization.

Atrium Hotels & Resorts will never ask you to make a booking payment to an unofficial bank account. Any payment request should be verified through our official booking channels or directly with the hotel using verified contact details.

 

11.5 Cancellations, amendments and no-shows

Cancellation, amendment, deposit, prepayment, refund and no-show terms vary depending on the rate, package, offer and booking channel selected.

You must review the specific payment and cancellation conditions applicable to your booking before confirming it.

To cancel or amend your booking, you should follow the instructions in your booking confirmation or contact the hotel using the official contact details provided in your confirmation.

If there is a dispute about the date or time when a cancellation or amendment request was received, you may be required to prove that the request was received within the applicable cancellation period.

After accommodation or other services have been provided, refunds are not available except where required by applicable law or expressly provided in the applicable booking conditions.

12. Changes or cancellation by Atrium Hotels & Resorts

Very occasionally, we may need to cancel or modify a booking. Where we cancel a confirmed accommodation booking for reasons within our control, you will be given a refund of amounts paid for the cancelled accommodation, unless an alternative arrangement is agreed.

We will use reasonable efforts to relocate any confirmed booking cancelled by us to an alternative Atrium Hotels & Resorts property or accommodation of similar standard, where available and appropriate.

We shall have no further liability arising from such cancellation, except where liability cannot be excluded under applicable law.

Your booking is for a room category or type and does not guarantee allocation of a specific room or the same room for the entire duration of your stay.

If you have indicated a preference for a particular room, we will use reasonable efforts to honor that preference, but we may allocate an alternative room for operational, maintenance, safety, security or availability reasons.

If we need to move you to a different room during your stay and a lower rate applies to that room, we will refund the difference where appropriate.

13. Check-in and check-out requirements

In the interests of security, legal compliance and fraud prevention, guests may be required at check-in to confirm their identity by providing a booking reference, passport or identity document and a valid credit or debit card.

The card may be swiped or authorized in the presence of the cardholder. We may request relevant information for each member of the party where required or permitted by applicable law.

We reserve the right to refuse accommodation to persons who cannot provide information or documentation required by law, booking conditions or reasonable hotel procedures.

Unless otherwise stated in your booking confirmation, check-in is available from 3:00 p.m. on the scheduled day of arrival.

Rooms secured by card guarantee or prepayment will be held until 11:59 p.m. on the scheduled day of arrival unless otherwise agreed directly with the hotel or stated in the applicable booking conditions.

On the day of departure, guests must vacate their rooms by 11:00 a.m., unless a later departure time is stated in the booking or agreed by the hotel.

Late check-out is subject to availability and may be charged at an hourly rate or other rate determined by the hotel.

14. Mobile application and digital guest services

Atrium Hotels & Resorts may make available a mobile application or other digital guest-service platform. Through the mobile application or related services, guests may be able to:

  • make restaurant reservations;
  • order room service;
  • communicate with guest relations, reception, concierge or other hotel teams through live chat or messaging;
  • request hotel services or assistance;
  • book or request spa, sports, leisure or other hotel services;
  • request or book lessons, activities, excursions, transfers or other services provided by independent third-party providers;
  • complete questionnaires, surveys or feedback forms;
  • receive service messages, notifications, offers or information relating to their stay.

The availability and functionality of the mobile application may vary by hotel, season, system status, service availability or operational needs. We may modify, suspend or discontinue any mobile-app feature at any time.

Requests submitted through the mobile application are not guaranteed until confirmed by the hotel or, where applicable, by the relevant third-party provider. Some services may be subject to availability, additional charges, age restrictions, cancellation rules, health and safety requirements, dress codes or other conditions.

You are responsible for ensuring that information submitted through the mobile application is accurate and up to date.

15. Restaurant reservations, room service and hotel services

Restaurant reservations, room service, spa services, sports facilities, leisure facilities, entertainment, activities, lessons and other hotel services may be subject to availability, operating hours, dress codes, age restrictions, safety rules, cancellation terms, charges and other conditions.

Submitting a request through the website, mobile application, concierge, guest relations or other channels does not guarantee availability or confirmation unless confirmed by the hotel.

Charges may apply for certain services, including spa, hairdressing, scuba diving, sports lessons, activities, private experiences, room service, premium facilities or other services. Please enquire directly with the hotel for details.

16. Third-party services, excursions, lessons and activities

Our website, mobile application, concierge, guest relations team or hotel staff may provide information about or help facilitate requests or bookings for services provided by independent third parties. These may include, without limitation, excursions, tours, boat trips, transfers, sports lessons, tennis lessons, wellness services, external activities, transport services or other experiences.

Unless expressly stated otherwise, such third-party services are provided exclusively by the relevant third-party provider and not by Atrium Hotels & Resorts. Atrium Hotels & Resorts may act only as an intermediary, facilitator, booking-support channel or collection agent, as applicable.

The third-party provider is responsible for:

  • the accuracy of information relating to its services;
  • availability, scheduling, changes and cancellations;
  • performance and quality of the service;
  • compliance with applicable laws, licences, permits and professional obligations;
  • safety, suitability, supervision and risk management;
  • insurance coverage and civil liability for the services it provides;
  • any acts, omissions, delays, accidents, injuries, losses, damages or disputes arising from the service.

Atrium Hotels & Resorts does not control and is not responsible for the acts, omissions, representations, errors, negligence, service quality, safety arrangements, insurance coverage, delays, cancellations, accidents, injuries, losses or damages caused by independent third-party providers, except to the extent that liability cannot be excluded under applicable law.

By requesting or booking a third-party service, you acknowledge that the service may be subject to the provider’s own terms, privacy notice, cancellation policy, safety rules, insurance conditions and participation requirements. You are responsible for reviewing and complying with those terms.

Atrium Hotels & Resorts may share the information necessary to process or support your request with the relevant third-party provider in accordance with our Privacy Policy / Privacy Notice.

Where payment for a third-party service is collected by Atrium Hotels & Resorts, this does not mean that Atrium Hotels & Resorts is the provider of that service, unless expressly stated otherwise.

17. Availability of services and facilities

Restaurants, bars, spa facilities, sports facilities, leisure facilities, entertainment, lessons, excursions, transfers, activities and other services may be subject to availability, seasonality, operational needs, weather conditions, safety requirements, minimum participation, provider availability, maintenance, private events or other circumstances beyond our control.

We may change, suspend, restrict or discontinue facilities, services, operating hours, menus, activities or experiences where reasonably necessary. We will try to inform guests where reasonably possible, but we are not responsible for the unavailability of a facility or service where this is caused by operational requirements, safety reasons, third-party provider issues or circumstances beyond our reasonable control.

If any facility, service or activity is a significant reason for your choice of hotel, you should check directly with the hotel before arrival or before confirming the relevant booking.

18. Accessibility

A selection of rooms designed for specific accessibility needs may be available at each of our hotels.

Please contact our call center at +30 22410 44901 to discuss specific requirements and availability of appropriate accommodation. We will do our best to accommodate your needs, subject to availability and operational feasibility.

19. Children and minors

All children and minors under 18 years of age staying at the hotel must be accompanied and supervised by an adult at all times.

Certain facilities, services or activities may be subject to minimum age requirements. For example, children over the age of 14 may be allowed to use spa facilities, subject to applicable hotel rules and supervision requirements.

Atrium Hotels & Resorts may apply dress-code policies in restaurants or other facilities, including a long-trousers policy for male guests, including children over the age of 12, where applicable.

20. Parking

Where a hotel has car park areas, spaces may be limited and availability is not guaranteed for the duration of your stay.

Terms and conditions may apply to car-park use. Please contact the hotel directly for more information.

Cars and their contents are left at the owner’s or customer’s own risk. We do not accept responsibility for loss or damage, except where liability cannot be excluded or restricted under applicable law

21. Hotel events

At certain times throughout the year, some hotels may host weddings, events, conferences, parties or other functions. You may consider such events to affect your stay.

Please contact the hotel directly in advance of your stay if this is important to you.

22. Smoking

Smoking is not permitted in guest rooms or in non-smoking areas.

Where designated smoking areas are available, guests must use only those areas.

Guests may be charged for cleaning, repair, deodorizing or other costs resulting from smoking in prohibited areas.

23. Pets and assistance animals

Pets are not permitted unless expressly agreed by the hotel in advance.

24. Damage and missing items

We reserve the right, and you authorize us, to charge your credit or debit card for damage caused to your room, hotel property, facilities, equipment or furnishings during your stay, including specialist cleaning costs, repair costs or replacement costs, and for items that are missing when you leave.

You are responsible for the conduct of all persons staying in or using the room or services under your booking.

25. Guest behaviour

Guests must conduct themselves appropriately at all times and comply with hotel procedures, safety instructions, staff requests and applicable law.

Guests must not disrupt the comfort, safety or enjoyment of other guests, interfere with the smooth operation of the hotel, damage property, cause offence, behave abusively, threaten staff or guests, or breach hotel rules.

In accordance with applicable law, including Article 8 of Law 1652/1986 where applicable, we may refuse accommodation or services, or remove you and members of your party from the hotel if, in our reasonable opinion, you or any member of your party:

  • may pose a risk to the health, safety or comfort of other guests, staff or visitors;
  • is intoxicated or behaving in a disorderly, threatening, abusive or unsafe manner;
  • breaches applicable law;
  • breaches these Terms, hotel policies or reasonable staff instructions;
  • acts contrary to public order or accepted standards of conduct.

Where this occurs, we shall have no obligation to refund lost accommodation, services or other expenses, except where required by applicable law.

26. Force majeure

Atrium Hotels & Resorts accepts no liability and will not pay compensation where the performance of its obligations is prevented, restricted, delayed or affected by events beyond its reasonable control. Such events may include, without limitation, flood, earthquake, extreme weather, natural disasters, fire, terrorism, war, civil unrest, epidemic or pandemic, governmental restrictions, strikes, interruption of utilities, failure of power, gas, water, telecommunications or internet services, technical failures, collapse of structures, transport disruption, supplier failure or any other event beyond our reasonable control.

27. Links and third-party websites

The website, mobile application or digital services may contain links to third-party websites, platforms, applications, booking engines, payment tools, activity providers or external services.

These links are provided for convenience and information only. Atrium Hotels & Resorts does not control and is not responsible for third-party websites, platforms, applications, content, privacy practices, security, availability, accuracy, products or services.

The inclusion of a link does not imply endorsement, approval or responsibility for the third-party website, platform, provider or service.

You should review the relevant third-party terms, privacy notices and policies before using third-party websites, applications or services.

28. Website, mobile application and service accuracy

We use reasonable efforts to ensure that information on the website, mobile application and related services is accurate and up to date. However, the website or services may contain errors, omissions, technical inaccuracies, outdated information or typographical errors.

Descriptions, images, prices, availability, facilities, services, operating hours, menus, activities, excursions, lessons and other information are provided for general information and may change without notice.

Atrium Hotels & Resorts reserves the right to make changes, corrections and improvements to the website, mobile application, services, facilities, offers, products and programs at any time without notice.

Where a facility, service, activity or third-party experience is important to your booking or stay, you should check directly with the hotel before arrival or before confirming the relevant service.

29. Communication errors and lost transactions 28. Website, mobile application and service accuracy

Atrium Hotels & Resorts and any provider of products or services related to the website, mobile application or services are not responsible for communication malfunctions, failures, delays, lost transmissions, misdirected messages, system errors, incorrect entries, interrupted connections, unauthorized interception or technical or human errors occurring in connection with the website or services, except where liability cannot be excluded under applicable law.

We may cancel, modify or correct reservations, purchases or service requests where they appear to contain or result from a mistake, system error, pricing error, availability error, fraudulent activity or inappropriate use.

30. Personal information and payment information

Personal information is processed in accordance with our Privacy Policy / Privacy Notice and Cookie Policy.

To the fullest extent permitted by law, Atrium Hotels & Resorts is not responsible for unauthorized interception, misuse or disclosure of information transmitted through third-party networks, devices, platforms, applications or websites that are not under our control.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law.

31. Use of third-party suppliers

In order to operate the website, mobile application, booking services, guest services and hotel services, Atrium Hotels & Resorts may use third-party suppliers, technology providers, booking engines, payment processors, communication platforms, app providers, service providers and contractors.

Where third-party suppliers provide services on our behalf, we remain responsible only to the extent required by applicable law and subject to the terms governing the relevant service.

Where independent third-party providers supply services directly to guests, including excursions, lessons, tours, transfers, external activities or other experiences, those providers are independent contractors and not employees, agents or representatives of Atrium Hotels & Resorts, unless expressly stated otherwise.

You agree to comply with all rules, conditions, charges, taxes, cancellation terms, safety instructions and participation requirements applicable to any service you request or book.

32. Additional terms

Additional terms and conditions may apply to reservations, purchases, restaurant bookings, room service, spa services, sports facilities, lessons, activities, excursions, transfers, third-party services, offers, packages, loyalty initiatives, digital services or specific parts of the website or mobile application.

By using such services, you agree to comply with the additional terms that apply to them.

33. Alternative dispute resolution

For alternative dispute resolution, you may contact competent Greek consumer-protection or alternative dispute resolution authorities, including the Hellenic Consumer Ombudsman and the competent authorities of the Ministry of Development, where applicable.

The parties shall first attempt in good faith to resolve any dispute amicably.

34. Severability

If any provision of these Terms is found to be invalid, illegal or unenforceable, that provision shall be enforced to the fullest extent permitted by law and the remaining provisions shall remain valid and enforceable.

35. Modification of these Terms

Atrium Hotels & Resorts may modify these Terms from time to time. The version in force at the time of your use of the website, mobile application, services or booking will apply.

You should review these Terms periodically. Continued use of the website, mobile application or services after changes are made constitutes acceptance of the updated Terms.

36. Disclaimer and exclusion of warranties

The website, mobile application, services and related information are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, Atrium Hotels & Resorts disclaims all warranties, express or implied, including warranties of title, merchantability, fitness for a particular purpose, non-infringement, availability, accuracy and uninterrupted operation.

Nothing in these Terms affects statutory rights that cannot be excluded or restricted under applicable law.

37. Limitation of liability

To the fullest extent permitted by law, Atrium Hotels & Resorts shall not be liable for indirect, consequential or purely economic loss, loss of profit, loss of goodwill, loss of opportunity, loss of data, loss of enjoyment, or any loss arising from circumstances beyond our reasonable control.

The total liability of Atrium Hotels & Resorts arising from or in connection with a booking or service shall not exceed the amount paid by you to Atrium Hotels & Resorts for the relevant booking or service, except where liability cannot be limited under applicable law.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, wilful misconduct or any other liability that cannot be excluded or limited under applicable law.

38. Indemnification

You agree to indemnify and hold harmless Atrium Hotels & Resorts, its companies, officers, directors, employees, agents and affiliates from and against any claim, demand, damage, loss, liability, cost or expense, including reasonable legal fees, arising from your breach of these Terms, your misuse of the website or services, your violation of applicable law, your violation of third-party rights, or the conduct of persons on whose behalf you make a booking or request.

39. Applicable law and jurisdiction

These Terms are governed by Greek law.

To the fullest extent permitted by law, any dispute arising out of or in connection with these Terms, the website, the mobile application, a booking, a stay or any related service shall be subject to the competent courts of Rhodes, Greece, unless mandatory consumer-protection rules provide otherwise.

40. Entire agreement

These Terms, together with the policies and documents incorporated or referred to in them, including the Privacy Policy / Privacy Notice, Cookie Policy and applicable booking conditions, constitute the agreement between you and Atrium Hotels & Resorts in relation to the subject matter covered by them and supersede any prior understandings or agreements relating to that subject matter.
